These terms apply to the use of acoeurdenfant-aety.com and to purchases made from A&Y – À Cœur d’Enfant, a sole proprietorship operated by Lamyaa Grich (NEQ 2282405705), 2600 Cavendish Boulevard, Montreal, Quebec H4B 0A8. By placing an order, you accept them. They do not limit in any way the rights granted to you by Quebec’s Consumer Protection Act (CPA).

1. Orders and contract

The contract is formed when you receive the order confirmation email. Before payment, checkout shows you the items, the price of each, shipping costs, taxes and the total, as well as the expected delivery time. The confirmation email repeats this information, as the CPA requires for a distance contract. We may refuse an order in case of an obvious error or suspected fraud; the amount paid is then refunded in full.

2. Prices

Prices are in Canadian dollars, plus taxes. A compared or crossed-out price is shown only if it matches a price actually charged at A&Y. In case of a price error, we cannot charge more than the price displayed when you ordered (CPA, s. 224).

3. Payment

Payment is by credit or debit card, Shop Pay, Apple Pay or Google Pay. For the ZEM Sack, ZEM Instalments allows 2, 3 or 4 monthly payments at 0% interest for approved files, the first being charged at shipment; its terms are shown before you agree.

4. Delivery

We deliver within Canada only. Times, fees and free-shipping thresholds are described in the shipping policy. If an order is not delivered within 30 days after the expected date, you may cancel it and be refunded, as provided by the CPA.

5. Pre-orders

A pre-order item shows its expected shipping date or period. You can cancel free of charge as long as it has not shipped (pre-order cancellation policy). Any significant delay is announced to you by email.

6. Returns, warranties and refunds

The return and refund policy applies. The legal warranties of quality, normal use and durability under the CPA apply to all products, whether bought at regular price or on sale.

7. Products and safety

We describe products, their materials and certifications as accurately as possible; colours may vary slightly depending on your screen. Always follow each product’s use and safety instructions. ZEM adaptive clothing does not replace the advice of your child’s medical team.

8. Promotions, codes and donations

Each promotion states its duration and conditions. 10% of sales of A&Y products, Petit Coulou excluded, are donated to the CHU Sainte-Justine Foundation; this contribution does not change the price you pay.

9. Customer account

You are responsible for keeping your login details confidential. Let us know of any unauthorized use of your account.

10. Customer reviews and content

By posting a review, photo or comment, you allow us to display it on the site and our social media, with the name you chose. Reviews must be honest and describe your own experience. A review posted in exchange for a benefit (free product, collaboration) is identified as such.

11. Intellectual property

The name A&Y – À Cœur d’Enfant, the Tout Doux, MINUS by A&Y and ZEM brands, and the site’s texts, photos and creations belong to A&Y or its partners. Any reproduction without written permission is prohibited.

12. Use of the site

It is prohibited to use the site for illegal purposes, to disrupt its operation or to extract its content by automated means.

13. Liability

We are liable for damage caused by our fault, within the limits allowed by law. No clause of these terms limits our liability toward a consumer beyond what the CPA allows.

14. Language

These terms are written in French. An English version is provided for your convenience; in case of discrepancy, the French version prevails.

15. Governing law and courts

These terms are governed by the laws of Quebec and Canada. Any dispute falls under the courts of the judicial district of Montreal, subject to your right, as a consumer, to bring a claim in the court of your place of residence. No mandatory arbitration clause applies.

16. Changes

We may change these terms; the version in force when you place an order applies to that order.
